Description: This course examines the evolving area of employee benefits litigation. Students will study litigation involving claims for benefits as well as claims for breaches of the fiduciary duty of those who administer the plans. Cases involving the risks employees face when purchasing employer stock from their employer, discretion accorded the employer in making decisions regarding claims for benefits, the elimination of retiree health benefits, the limitation of damages for medical claims, as well as other topics, will all be studied.
